Germany: Insurance against risk of xylella, ALB and CLB

The horticulture insurance company Gartenbau-Versicherung (GV) published information already at the beginning of March on its upcoming insurance against the effects of the incidence of certain quarantine pests such as the bacteria xylella fastidiosa, the Asian long-horned beetle (ALB) and the citrus long-horned beetle (CLB). This work has now been completed.

Members can supplement their insurance protection with immediate effect by agreeing to the negotiated clauses that relate specifically to the relevant target groups. According to GV most of the individual letters have already been sent.

For the target groups for insurance protection against xylella, ALB and CLB:
  • Businesses with greenhouse crops who have taken out so-called spoilage damage insurance (TV-Verderb) in the insurance product Hortisecur G.
  • Businesses with open-air production who have multiple risk insurance in the product Hortisecur F.
  • Garden centres and retail operations with insurance against business interruption due to fire.
What does the insurance protection include? According to our information the extended cover refers to damage to yield caused by a quarantine decree ordered by the authorities because of the three pests xylella fastidiosa, ALB and CLB.

Basic prerequisite: quarantine decree by the authorities
For horticultural operations with greenhouse crops and/or open air production the insurance cover is for losses of clearly healthy plants caused by a ban on movement from an infested or buffer zone.

The insurance also covers a loss of value added in subsequent production steps and/or subsequent crops if no replacement plants can be acquired. This is also valid if the areas planned for this purpose may not be used because of quarantine decree or if they cannot be used for economic reasons. The period of liability is twelve months from the date of the quarantine decree.

Official eradication measure: plant stocks not yet covered
Plant stock that need to be destroyed on the grounds of an officially decreed eradication measure is not covered. For decreed eradication measures the new EU directive on the protection of plant pests that is to be applied from December 2019 onwards includes possible state compensation if national systems exist for this purpose. GV reminds politicians and trade associations that they must take action on this point.

For retail operations or garden centres GV provides compensation for interruption damage if the operation is not able or only able at a later date to market plant stocks or if parts of the sales area are off limits. This is provided that a so-called infestation or buffer zone has been declared by means of an official quarantine decree and that a movement ban has been announced for certain plants. The insurance still does not cover plant stocks that need to be destroyed on the basis of an officially decreed eradication measure.

The insurance also covers cases where operations are interrupted because of the declaration of a restricted area due to disease and the associated traffic limitations.

Cover includes lost value added
According to GV the cover is both for the over-aging of plants and for lost value added. The insurance also covers disposal and/or disinfection costs for affected plants and goods as well as any disinfection costs for facilities and buildings. It also includes interruption damage caused by failure to deliver or the late delivery of goods from business partners inside the EU, the EEA or Switzerland that is incurred because of traffic limitations or quarantine decrees declared there.

Insurance costs
How high are the costs of insurance protection against the effects of the incidence of certain quarantine pests (xylella, ALB and CLB)? GV (Wiesbaden) stated in TASPO, the most important weekly horticulture newspaper, that the annual contribution for this insurance cover for each 100,000 Euros insured would be between 70 and 150 Euros, whereby the possibility of discounts for freedom from pests and for multiple years of contributions still needs to be taken into account. Statutory insurance tax (19 percent) must be added to this.
